Doctors Awarded 12 million in Lawsuit

Yes. You read the headline right. Two Scottsdale doctors were awarded 12 million dollars in a lawsuit they filed according to ClaimsJournal.Com. The suit was a defamation case. Reportedly, a former patient of the doctors had posted information on the internet that the jury found to be untrue. The doctors’ lawyers successfully argued that the internet postings damaged their practice. This is a good case study to show that you have to use wisdom about what you post on the internet least you find yourself being sued for defamation. What do you do if the person who caused the wreck does not have enough insurance?

This is part two of another blog.  If the person who struck your car doing you damage does not have enough insurance, your own uninsured motorist insurance may help.  This is sometimes referred to by the courts as underinsurance.  It comes to your assistance if the negligent party had insurance less than yours.  For example, assume you had medical bills of $40,000.00.  The negligent driver had policy limit of $25,000.00.  Assume you had an uninsured (underinsured) motorist insurance of $100,000.00.  Then, your uninsured/underinsured policy would be available to help cover your damages.  This insurance is also available on occasions to stack coverage on the other parties liability coverage.  This means it would be in addition to the negligent parties liability coverage.  You should contact an personal injury lawyer if you have questions about this issue.  How you handle the claim early in the case can make a large difference in your end result.  Check with your agent and be sure you have uninsured motorist coverage that will allow for stacking in case of a wreck.

Automobile insurance you need on every car!

Uninsured motorist insurance is insurance you need on every car you own.  It is relatively inexpensive compared to the benefit it provides if you ever need it.  In Georgia, it provides two benefits.  One is the true uninsured motorist benefit.  If someone is negligent and strikes your car causing you damage, the next question is do they have insurance to cover the damage.  If they do not have insurance, then your uninsured motorist coverage would pay you for your injuries.  Remember when you talk with your own agent about a wreck, if the other party does not have insurance, you may have bring an action against your own insurance company.  So be aware of this when you are discussing your case with your on agents or adjuster.

Tick! Tock! Is your workers compensation claim about to expire?

clockRecently a client came into our office for a free initial consultation about her workers compensation injury. It had happened sometime ago. Her employer did not tell her she was entitled to additional benefits. Her employer did not tell her that if she did not take immediate legal action she would be forever barred from getting these benefits which she is entitled to under Georgia law. She was literally days away from this bar to her case occurring.

The insurance company and adjuster for the employer did not tell her she was about to lose her benefits either. Tick! Tock! Tick! Tock! Are you a person with a worker compensation injury who is about to loose your benefits? Tick! Tock!
Because of our technology and training, we filed her claim in Atlanta, Georgia, the same day protecting her benefits until we could settle the case or try it. We were able to get her treated again under her Workers Compensation benefits. This case is not over. But now she has experienced legal counsel to make sure that she gets all of her benefits. Again, there were with no upfront legal cost for the initial consultation. Usually fees are paid out of the settlement that we obtain for our clients.
